  • Lead counsel representing forensic science technicians in first amendment challenge to labor contract provision prohibiting nonunion bargaining unit members from obtaining union-administered dental/vision group insurance available under public employer’s flexible benefits plan.  First case in nation to hold that discrimination in terms and conditions of employment against nonunion public-sector employees violates the Constitution.  Plaintiff’s attorney’s fees ($143,000) paid by defendant. ​


  • Lead counsel representing plaintiffs in five strike-violence cases arising from labor union’s strike against automobile brake manufacturing plant. Plaintiffs alleged civil conspiracy to commit various unlawful acts incident to strike at plant; cases settled for undisclosed sums.


  • Defeated unfair labor practice charge filed with NLRB alleging employer failed to bargain with or recognize labor union after employer was awarded contract to provide previously unionized baggage handling services at airport.


  • Represented national accounting firm in lawsuit by former partner and director alleging wrongful termination under Florida Whistleblower Act, breach of operating agreement, and tortious inference with business relationships.


  • Lead counsel in class action representing 3300 nonunion state employees alleging first amendment violations in connection with labor union’s financial disclosure provided to nonunion agency fee payers.  Court granted summary judgment for plaintiffs. Plaintiff’s attorney’s fees ($180,000) paid by defendant. 


  • Represented hospital in class and collective action where nurses and patient care providers alleged breach of contract and overtime violations arising from alleged uncompensated off-the-clock work.


  • Represented pharmaceutical company in action against competitor for tortious interference with former sales representatives’ non-compete agreements.

 

  • Represented salesman in arbitration of dispute over payment of commissions; case settled favorably for amount sought in original complaint ($500,000).


  • Represented Lubavich Rabbi and Synagogue in federal civil rights lawsuit.  Municipality enforced zoning and fire code regulations to prohibit Rabbi from (a) erecting canopy adjacent to residence at outdoor religious celebration and (b) meeting with coreligionists at residence for weekly prayer and worship. Court ruled in favor of plaintiffs under federal and state law; Appellate court affirmed on state-law grounds.

  • Lead counsel representing employer in FLSA collective action where the court rejected skycaps' claims against aviation support services provider alleging, among other things, improper use of tip credit. Affirmed by appellate court.  Leading case on tip credit notice and duties comprising tipped occupation.

  • Represented munitions production worker alleging employer and labor union refused to accommodate his religious objections to supporting labor union through compulsory union fees.  District court ruled for the plaintiff.  Defendants paid plaintiff’s attorney’s fees.

  • Lead counsel representing truck driver in strike violence lawsuit against international and local labor union alleging civil conspiracy, assault and battery, racketeering and other claims. Plaintiff was attacked and stabbed while stopped at a traffic light while delivering packages. Case settled for an undisclosed sum.
